Verschillende soorten legalisatie van documenten

Documenten welke in een buitenlands land zijn uitgegeven dienen te worden gelegaliseerd om hun geldigheid in een ander land te bevestigen.

Het legaliseren van documenten bevestigt de authenticiteit van de stempels en handtekeningen van geautoriseerde ambtenaren welke een document hebben uitgegeven. Documenten kunnen alleen worden gelegaliseerd in het land waarin ze zijn uitgegeven. Dat wil zeggen, documenten uitgegeven in Nederland kunnen alleen gelegaliseerd worden in Nederland.

3 typen legalisatie

Maar niet iedere legalisatie vraagt om dezelfde aanpak. Ieder buitenlands document is immers anders. We onderscheiden 3 vormen van legalisatie:

Apostille

Nederland is onderhevig aan de Haagse Apostille Conventie van 1961. Daardoor kunnen documenten die geldig zijn in een land, worden erkend door publieke autoriteiten en andere organisaties van een ander land onder de jurisdictie van de Haagse conventie.

Met andere woorden: documenten met een Apostille stempel zullen automatisch als geldig worden erkend in alle landen van de Haagse Conventie. In Nederland kan een apostille stempel worden verstrekt in het Nederlands, Engels, Frans en Duits, Spaans en Italiaans. JuridConsult biedt ook Apostille vertalingsdiensten.

Ministeriële legalisatie (legelisatie bij het Ministerie van Buitenlandse Zaken)

Nederlandse documenten voor buitenlands gebruik worden gelegaliseerd in één van de Ministeries van Nederland. In veel gevallen dienen ministeriële legalisatie documenten te worden gelegaliseerd met een apostille stempel.

Zodoende wordt de authenticiteit van de handtekening van de ambtenaar gecertificeerd. Maar ook de capaciteit waarin die ambtenaar handelde. En eventueel de identiteit van de zegel of stempel die het document draagt. De Apostille valideert de inhoud van de documenten niet.

Ambassade / consulaire legalisatie

Anders dan Apostille, wordt legalisatie door de ambassade/consulaire legalisatie gebruikt voor documenten die bedoeld zijn voor circulatie in staten die geen partij zijn van de Haagse Conventie.

Legalisatie door de ambassade of consulaire legalisatie wordt uitgevoerd in ambassades of consulaten van landen waar gelegaliseerde documenten gebruikt zullen worden.

Diploma’s;
Cijferlijsten;
Andere documenten.

Luis and his team deserve 5 starts! We found them through youtube when I was puzzled with all rules and regulations for my apostille for my birthcertificate which I needed very fast! His movies explained easily what it was, and what needed to be done. We decided to make use of his services, there are many providers but all of them request you sending your birth certificate across seas. I didnt feel comfortable with this but with Luis he accepted a photocopy and organized everything for us within 3 days! I was very amazed by the quickness and the updates from his side.
